Hearing Examiner’s Options
The Hearing Examiner has until Aug 20/Sept 19 to make her recommendation on the rezoning application (45-75 days from July 6 when the record closed).
The Hearing Examiner has many options of what she can recommend. She can say:
- “Yes” to everything the developer requested
- “No” to everything the developer requested
- Anything in between such as:
o recommend the developer reduce the density, height, etc;
o recommend new binding element(s); or
o recommend remand for additional testimony on specific matters
The recommendation will be made to the Montgomery County Council who will then have the final vote "Yes or No" on whether the rezoning for the townhouses can occur.
The FINAL VOTE by the Montgomery County Council could occur as early as September but more likely in October or December 2026. We will need a HUGE TURNOUT for that VOTE in OCT or DEC 2026. MORE TO COME later on this.
